I think it's probably going to be changed to allow LP's before it's passed, there is a huge uproar in the states about it from what I can tell on Youtube.

If we show any part of TI-OS, then technically yes.
Another law presented by lobbyists on a paycheck and under the control of people who don't understand the consequences.

It'll never take effect, though, 99% of videos featuring gameplay fall under fair use.

Because of how it's worded and this little snippet I found in the bill:
‘(B)(i) the total retail value of the performances, or the total economic value of such public performances to the infringer or to the copyright owner, would exceed $2,500;
It basically says that if the copyright owner or the infringer made more that $2500 off the performances it's a felony.

I think the part about the copyright owner is meant to say that if they *lost* more than $2500 on the performance, not that they made that money off such a performance.

That has nothing about loss I'm afraid. I directly copied it (with adding the bold) From my interpretation if the copyright owner made $$$ off of it, it's still a felony. :S

So you can't make money on game footage? Well it's kinda better now. I think. I think I need a lawyer to get this explained.

I can see how this would be a tricky thing to decide for lawmakers, courts, etc. On one hand, it's your computer that is generating the graphics, on the other, it uses the copyrighted assets of the video game to do so. If this was passed, though, I could see many video game companies giving their customers the right to make lets plays automatically, probably through the EULAs.

That's a misleading interpretation, then. The bill concerns copyright infringement. The copyright owner can't infringe upon their own copyright.

even worse, this means that unless you strip all traces of TI from your TI calc, you can be imprisoned for showing video's of your latest calc project X__________X

Unless TI loses $2500 from your 10 calc videos posted in under one hundred eighty days, you probably can't be successfully
persecuted prosecuted :P

Hell streaming video games period doesn't make companies lose money. Which is what they are going for with this.

I don't believe it is just games. It includes movies and I believe media as a whole, unless properly licensed to do so.

Of course, Kakeyo's only a law student and I know even less, but I've read up and what she's saying seems pretty sound.

It's not targeted at games but due to wording issues, games are included.

...unless you upload your video to an american server. In fact YouTube would just block your video in USA, so it's kinda bad if you have American viewers.

I did read the bill and it's surprisingly short. A quick change in wording on a single line is all that it would take to fix the issue. The reason why it's so short is because it is an amendment to a previous law. What s.978 does is it redefines copyrighted material while increasing the punishment for breaking copyright law.
