Title: Do u think this is fair?
Post by: BalancedFury on October 13, 2011, 07:25:45 pm: Someone puked in school today, because some guy turned on a very disgusting and inappropriate video...
The teachers came because everybody freaked out, and then took everyone around's phone if it had internet access and gave us a referral for ASD...
I got my Iphone 5G taken away, and I got ASD, so i'm grounded for 3 weeks...

That's the point.
If one person turned on that thing, only that person should have been punished
On my referral, it said Watching inappropriate videos and having cellphones in school..
It was 7:30 and the rules is no cellphones from 7:45 ~ 3:00
I told them that and they said if I keep talking, I will get additional punishment

Among the few things that really piss me off.

I agree. Get your parents involved; they have more currency than you do. Though they might be unhappy that you watched it (if you did), detention etc. are still uncalled for.

The school took away your phone outside it's own policy and punished you for technically no legitimate reason. Make sure to read up on school policy and see if there's any clause about watching inappropriate media. If there's not, or if you didn't watch the vid, that can't do anything to you.

Explain the situation to your parents. They might still ground you for watching the video but if the way the school handled the situation was wrong (which it seems like it was) they will side with you on this.

side note: I love having a lax-ish school. my vice principal is great. he jokes around with us and I didnt get in trouble for taping down a can of Axe in a kids locker who didnt lock it. Kid deserved it any ways and the vice principal kinda laughed at it too :P

Good luck getting it back. My High school would take phones for the rest of the semester, then "lose" them. Somehow, the security people were always getting new phones too...

Over here it was typical. For example the teacher in 5th year of elementary school cancelled all computer classes with french/math/geography for the remainder of the school year because two or three students in the class of 25 people kept talking too much.

Also over here, when something was taken away, like a calculator, most of the time you couldn't get it back until the end of the school year and in some cases I even heard about cases where the teacher lost it and the student never got it back.

If I was you I would get your parents involved or something.

Cause let's say person X skipped school, or went off campus w/o permission and got caught...
They give you 3 days of OSS which is pretty stupid, because that's what they wanted to do anyways...

I'm pretty sure if you go to a public school, during the school day (from the time HR starts, to the time you leave) the school is considered your guardian (to a point). So they can take it away, but they have no right to keep it for longer than the school day.

The do have to give it back to the parent/guardian though otherwise it would be considered stealing. If the student is of legal age they can get it back themselves and the school can't refuse them.

I didn't. But, the new assisstant principal is a prick..
He took everyone around's phone that had access to internet, and the phone internet is also being watched like the other monitors.
He said phones with internet is a "bad influence" to innocent people in 8th grade
I almost laughed at that cause really.... there are no innocent 8th grader :P

If they have nothing that gives them the right legally then your parents can get back the phone before the time is up.
